The Thrashers were en route to church when their vehicle collided with one driven by a man who had had his license suspended eight times. The man, 38-year-old Kenneth Nelms of Anderson, is in jail awaiting trial on charges of failing to yield the right of way, driving under a suspended license, leaving the scene of a fatal crash and violation of probation. Authorities say there is a growing problem of people driving without a license or driving with a suspended license.

The day before 76-year-old Mildred Thrasher died she had decided she wanted to live a little.
Having been the penny-pinching wife for 62 years, she told her husband on Nov. 5, that they might as well spend the money they had saved. She suggested driving to Columbia to see her sister. Jack Thrasher said they would go right after the Sunday service at Southside Baptist Church.
At 9:45 a.m. the next day, the Thrashers, of Anderson, walked out of their home on Bowden Street and headed for Sunday school.
About the same time, 38-year-old Kenneth Nelms of Anderson was climbing into the driver seat of a Honda not more than 300 yards from the intersection of South Main Street and Masters Drive.
Less than a half-mile into the drive, the Thrashers’ van and Mr. Nelms’ Honda collided, ending the couple’s drive almost within sight of their gray-stoned country church on South Main Street.
"I told her that I hated to miss church two Sundays in a row," Mr. Thrasher said. "I said, ‘Let’s go to church tomorrow and we’ll go from there.’ But we never did make it to church."
Ten hours later, Mrs. Thrasher died at the AnMed Health Center. And the saga for her family was just beginning as they learned Mr. Nelms was not supposed to be driving at all that day.
Left with lots of questions, few answers When the crash occurred, Mr. Nelms’ license had been suspended — for the eighth time.
State records show Mr. Nelms’ license was suspended eight times between March 2004 and November 2002. Days before the crash, probation agent Wanda Johnson warned Mr. Nelms that his license was suspended and if he were arrested for driving without license, his probation would be revoked.
The Thrasher family is left wondering why Mr. Nelms was on the road at all — warning or no warning.
"If they’d kept Mr. Nelms in jail, my mother would still be alive today," said one of the Thrashers’ children, Richard Thrasher.
Peter O’Boyle, a spokesman with the South Carolina Department of Probation, Pardon and Parole, said Mr. Nelms’ was sentenced to five years’ probation in March 2004 after being convicted on charges of narcotics possession, grand larceny and driving with a suspended license.
Records show Mr. Nelms was not arrested for any offenses between the March 2004 sentence and the November crash. "If he was caught driving, then that would have been grounds to revoke his probation," Mr. O’Boyle said.
Now, the Anderson County Detention Center is holding Mr. Nelms on $75,000 bond. He is awaiting trial on charges of failing to yield the right of way, driving under a suspended license, leaving the scene of a fatal crash and violation of probation. His trial is tentatively set for June 19, 10th Circuit Solicitor assistant Rosemary Jones said.
Unlicensed to drive Families like the Thrashers are not alone.
No one knows that better than Robert Scopatz.
In 2003, Mr. Scopatz, with Data Nexus Inc. of Texas, worked on a study for the AAA Foundation for Traffic Safety, titled "Licensed to Kill," It showed that unlicensed drivers are four times more likely to be involved in a fatal crash than licensed drivers. Two-thirds of those drivers with suspended licenses continue to drive, the study found.
"What we are recognizing is that behind drunk drivers, these people are the next-worse category of drivers out there. And drunk drivers are in that mix," Mr. Scopatz said. "They are four times as likely to cause a fatal crash. In traffic safety, that is a big deal. These are seriously bad drivers."
As of December, 156,452 motorists, out of the 3 million licensed drivers in South Carolina have suspended or revoked licenses, according to South Carolina Department of Motor Vehicles records.
In Anderson County, 6,090 drivers have had their license suspended or revoked. Oconee County has 2,056 motorists with withdrawn driving privileges and Pickens County has 3,044.
Last year, drivers with a suspended license were involved in 229 crashes in Anderson, Oconee, Pickens and Abbeville counties. There were 6,816 total collisions reported in the four counties in 2005.
Data on how many of those 229 crashes were fatal was not available.
Anderson County Sheriff’s Sgt. Henry Stone said he and his four-officer team set up license checkpoints in the county’s known drug areas or high-traffic areas to catch offenders of all kinds. Out of the estimated 20 to 30 checkpoints the team has set up this year, at least three tickets or arrests were made at each checkpoint for someone caught driving with a suspended license.
"We write them a ticket," Sgt. Stone said. "If it is more than the first offense, we will arrest them and put them in jail."
The South Carolina Highway Patrol also conducts license checkpoints to catch violators and in some cases, troopers will take a motorist’s license plate if they are caught driving with a suspended license and are under the influence of alcohol, patrol spokesman Lance Cpl. Dan Marsceau said.
"The law does allow for the removal of the license plate for someone who is convicted of driving with a suspended license," Mr. Marsceau said. "There are some circumstances where the plate would be taken at the time of arrest, such as when someone is charged with driving under the influence and they register more than a 0.15 on the Data Master."
Despite the measures taken by law enforcement, drivers like Mr. Nelms continue to drive.
State DMV spokeswoman Beth Parks said, the worst case she has seen in her long career with the department is one motorist who had 22 suspensions. "He told us that we were ‘forcing him to drive," Ms. Parks said.
Driving home the point So how can they be stopped?
Mr. Scopatz said attitudes toward motorists with suspended licenses need to change and punishments need to be stiff. The huge push created by organizations such as Mothers Against Drunk Drinking to raise awareness about the dangers of drunk driving needs to be replicated for suspended drivers, he said.
"People are much more likely to take the keys away from a drunk driver," Mr. Scopatz said. "The same kind of thing needs to happen in this situation. These people are just not hard luck cases that still need to drive to feed themselves. They are dangerous drivers that often kill people."
Secondly, states need to look at what they do to people who are driving with a suspended license, he said.
In Mr. Nelms’ case, he was convicted of multiple charges, including driving with a suspended license in 2004. He received probation — no jail time.
Some states make it harder for suspended motorist to drive.
The AAA survey shows how six states — California, Florida, Iowa, Michigan, Minnesota and Oregon — managed to rank below the national average in the number of fatal crashes that involved someone with a suspended or revoked license.
All six states have programs that lock a driver’s vehicle so it can not be driven if they have been charged repeatedly for driving with a suspended or revoked license. Four of the six allow for vehicles to be impounded when a person is caught driving without a license. And two states had laws that would keep drivers who have been convicted of driving under the influence from being able to register a vehicle.
Minnesota law allows officers to take a suspended driver’s license plate until they satisfy the reinstatement requirements set by the department of motor vehicles.
In South Carolina, most suspensions require the driver take one or more traffic education classes, pay a $100 re-instatement fee and another estimated $500 for state SR-22 insurance to get their license back.
Rep. Scott Talley, R-Spartanburg, introduced a bill in January that would stiffen the fines from $50 up to $400 for those caught driving without a license. But the bill did not survive the 2006 legislative session in Columbia, Rep. Talley said. It was part of a bill to raise penalties for speeders, which he said could decrease fatalities on the state’s roadways.
"It won’t stop everybody but I do think there is a chance that people will think more about it when it hits them in the pocketbook harder," Rep. Talley said. He plans to introduce the bill again, in the next session.
While state Sen. Kevin Bryant, R-Anderson, said he has not researched the issue in-depth, he did say that it seems the law needs to change after he heard of Mrs. Thrasher’s death.
"By listening to the details of this case, it seems to me that something certainly needs to be done," Sen. Bryant said. "Let’s say you have your license suspended two or three times, you should just not be able to get a license again. And I wouldn’t have a problem with someone’s vehicle being towed away if it meant saving someone’s life."
"I mean eight times — that’s ridiculous," the senator added.
Too little, too late But for the Thrashers, a new law, increased fines or higher premiums don’t matter too much.
Mr. Thrasher sits in the recliner next to the chair that used to be his wife’s favorite seat. He watches television and rocks back and forth. When he thinks about that November morning, he can still remember seeing his wife and feeling completely helpless.
"I could see her...," Mr. Thrasher said, stopping for a moment. "I just couldn’t unbuckle that belt."
Now, the man, who never had to worry about the usual details of life because his wife took care of "everything," is lost. The couple met while Mr. Thrasher was in the Air Force. They did everything together. They were regular customers at Staton’s Diner on S.C. 24. As they both aged, Mrs. Thrasher would often feed her husband and always paid the bills.
"She looked after me as good as some would a child," Mr. Thrasher said. "Now I pick up the phone to hand it to her before I realize what I am doing."
